Preamble<\/strong>These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all orders placed through the byop-design-arts.com website with OLIVIERPICHCREATIVEDESIGNS, for the purchase of e-books and digital e-posters, hereinafter referred to as \u201cDigital Products.\u201dPlacing an order implies full and unconditional acceptance of these GTC.<\/p>\n\n

1. Legal information about the publisher \/ seller<\/h2>\n\n

In accordance with the legal notice available on the site, full company details (legal form, registered office, SIRET number, address, email address, telephone number, etc.) can be found at: https: \/\/byop-design-arts.com\/mentions-legales\/<\/a><\/p>\n\n

The seller undertakes to update his contact details if necessary.<\/p>\n\n

2. Object<\/h2>\n\n

These Terms and Conditions of Sale are intended to define the rights and obligations of the parties in connection with the online sale of Digital Products (e-books, digital e-posters). The seller offers for sale downloadable digital files, available as a one-time download (with a license number), under the terms and conditions set forth below. <\/p>\n\n

3. Digital product features<\/h2>\n\n
    \n
  • The products offered are digital files (PDF format, image, etc.) for download.<\/li>\n\n\n\n
  • The file will be available for download only once<\/strong> during the transaction (or via a secure interface).<\/li>\n\n\n\n
  • Each download is linked to a unique identifier\/license and possibly a key or number.<\/li>\n\n\n\n
  • If the customer loses access or wishes to download again, he\/she may request this from the site administrator, subject to verification of identity and the conditions laid down (e.g. proof of purchase).<\/li>\n\n\n\n
  • The seller undertakes to provide a valid download link for a reasonable period (e.g. 30 days) after purchase, unless otherwise specified.<\/li>\n<\/ul>\n\n

    4. Awards<\/h2>\n\n
      \n
    • Prices are quoted in euros (\u20ac), inclusive of all taxes.<\/li>\n\n\n\n
    • In accordance with the law on the price of digital books<\/strong>, the ebook is subject to a single price set by the publisher.<\/li>\n\n\n\n
    • The seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the order is validated.<\/li>\n\n\n\n
    • Service charges (e.g. payment fees) may be indicated separately, if available.<\/li>\n<\/ul>\n\n

      5. Control<\/h2>\n\n
        \n
      • The buyer places an order via the website, following the order process.<\/li>\n\n\n\n
      • Before final validation of the order, the purchaser must expressly accept these GTC (check box, “I accept” button).<\/li>\n\n\n\n
      • The seller reserves the right to refuse an order for legitimate reasons (e.g. fraud, malfunction, etc.).<\/li>\n\n\n\n
      • Once the order has been validated, the buyer receives an email confirming the order with a summary (product, price, login details, download conditions).<\/li>\n<\/ul>\n\n

        6. Payment<\/h2>\n\n

        • Payment is made online using the methods offered on the site (credit card, PayPal, etc.).<\/li>\n\n\n\n
        • Payment is secure.<\/li>\n\n\n\n
        • The seller reserves the right to suspend the execution of the order (access to the download) until full payment has been received.<\/li>\n<\/ul>\n\n

          7. Download \/ Digital Delivery<\/h2>\n\n
            \n
          • Once payment has been confirmed, the buyer receives instructions or a link to download the digital file.<\/li>\n\n\n\n
          • This link can be used only once (or as otherwise specified).<\/li>\n\n\n\n
          • The seller declines all responsibility if the buyer is unable to download the file due to faulty hardware, software or connection on the customer’s side.<\/li>\n<\/ul>\n\n

            8. Right of withdrawal \/ refund<\/h2>\n\n

            The right of withdrawal under the Consumer Code (14 days) does not apply<\/strong> when the contract concerns the supply of digital content not provided on a physical medium<\/strong>, and performance has begun with the consumer’s express agreement before the end of the withdrawal period. <\/p>\n\n

            Therefore :<\/p>\n\n

              \n
            • The buyer is expressly informed before the validation of the order that the download will begin immediately and that he will lose his right of withdrawal.<\/li>\n\n\n\n
            • No refunds will be given once the download has begun and the license has been delivered.<\/li>\n\n\n\n
            • If, however, a malfunction is proven (corrupted file, technical failure on the part of the seller), the seller may, at its discretion, offer to reissue or repair the file, or in exceptional cases a partial or total refund, subject to agreement between the parties.<\/li>\n<\/ul>\n\n

              9. Intellectual property \/ license<\/h2>\n\n

              • The purchaser acquires a non-exclusive, non-transferable license for the personal use of<\/strong> the digital files purchased.<\/li>\n\n\n\n
              • Any reproduction, distribution, resale, modification, adaptation or commercial exploitation of the content is strictly forbidden without the prior written consent of the seller.<\/li>\n\n\n\n
              • The seller retains all copyrights and intellectual property rights on the works, covers, texts, illustrations, etc.<\/li>\n<\/ul>\n\n

                10. Legal warranties<\/h2>\n\n
                  \n
                • As a consumer, the purchaser benefits from the legal guarantee of conformity and the guarantee of hidden defects in accordance with the French Consumer Code (articles L. 217-4 et seq.) and the French Civil Code. <\/li>\n\n\n\n
                • However, given the digital nature of the products, the seller’s liability is limited within the framework provided by law, in particular in the event of a file defect (corruption): in this case, the seller may offer to re-issue the correct file or an appropriate solution.<\/li>\n\n\n\n
                • Any clause limiting or excluding the warranty in the event of bad faith on the part of the seller may be null and void.<\/li>\n<\/ul>\n\n

                  11. Liability<\/h2>\n\n

                  • The seller is not liable for any consequential damages resulting from the purchase.<\/li>\n\n\n\n
                  • The seller’s liability is limited to the amount of the order.<\/li>\n<\/ul>\n\n

                    12. Personal data<\/h2>\n\n
                      \n
                    • The seller collects and processes the buyer’s personal data (name, email address, etc.) in compliance with the RGPD and French legislation.<\/li>\n\n\n\n
                    • A detailed privacy policy must be available on the site.<\/li>\n\n\n\n
                    • The buyer has a right of access, rectification, deletion and opposition according to legal procedures.<\/li>\n<\/ul>\n\n

                      13. Mediation \/ complaints<\/h2>\n\n
                        \n
                      • In the event of a dispute, the purchaser may send a complaint to the customer service department (e-mail address or postal address indicated in the legal notice).<\/li>\n\n\n\n
                      • If no amicable agreement can be reached, the buyer may have free recourse to the competent consumer mediator (whose contact details must be indicated in the GTCS).<\/li>\n\n\n\n
                      • The mediator can be called upon before any legal action is taken.<\/li>\n<\/ul>\n\n

                        14. Applicable law and jurisdiction<\/h2>\n\n
                          \n
                        • These terms and conditions are governed by French law.<\/li>\n\n\n\n
                        • In the event of a dispute, the French courts will have jurisdiction, unless otherwise stipulated by mandatory law.<\/li>\n\n\n\n
                        • Consumers may choose between the court in their place of residence or the court in the seller’s place of business (within the limits set by law).<\/li>\n<\/ul>\n\n

                          15. Force majeure clause<\/h2>\n\n

                          Neither party will be held responsible for a breach of its obligations if this breach is caused by an event of force majeure as defined by French case law.<\/p>\n\n

                          16. Acceptance\/modification of the GTCS<\/h2>\n\n

                          • Acceptance of the GTCS is evidenced by the buyer’s action when placing an order (checkbox).<\/li>\n\n\n\n
                          • The seller reserves the right to modify these GTC. The new terms and conditions will apply to orders placed after they are posted online. <\/li>\n\n\n\n
                          • An archived version of the previous GTC may be kept as proof.<\/li>\n<\/ul>\n\n
